In Florida, as in many other states, real estate is governed by what we call the statute of frauds. Any real estate transaction that requires a written contract, any oral representations or oral promises cannot be incorporated into a written contract unless they are written into it. Therefore, oral promises or oral contracts basically have no effect and are not enforceable in real estate transactions.
