In simplest terms, under Florida law, an assault is a threat to do violence against another person with the apparent ability to carry that threat out, and that threat being imminent or about to happen. If a person threatens another person with physical violence and makes that person afraid that it’s about to happen, and that person looks like they have the ability to carry out the threat, that can constitute an assault in the state of Florida. A simple assault is a misdemeanor. However, more severe versions of this same crime can be charged as a felony.
