In Florida, under both state and federal law, certain offenses, that if you’re convicted of them, carry what they call a minimum mandatory sentences. Some of those include drug trafficking offenses or offenses involving a firearm or a deadly weapon that’s used during the commission of a crime. Those types of crimes can often carry a minimum mandatory term of prison, where the judge will not have any discretion to sentence you to anything other than the minimum mandatory sentence, as ordered by the legislature. So if it’s a three year or a 25 year minimum mandatory sentence, the court will have to impose that sentence on you. And in a general sense, most of these minimum mandatory terms of prison are served day for day. There is no early release and there is no gain time awarded on minimal mandatory sentences. And again, these crimes exist in both federal and state court.
